Inserting the victim in criminal dogmatics

Resumo: This article begins with the development of the victim figure, studied by criminology in the field of victimology. With the advancement of the criminal sciences, dogmatic began to give higher importance to the offended of the punishable fact. Thus, it sought to absorb part of the concepts developed within criminology, dogmatizing the relevance of the figure in the general and special part of penal codes. The work is grounded mainly on the Brazilian and Portuguese CP, which have a similar principle basis. The reflexes caused by this adaptation are found, mainly, in the offended criminal consent and in the theory of objective imputation, with self-placement and hetero-placement in danger. Finally, it analyzes the main consequences brought by these figures within criminal law.

Com o avanço das ciências criminais, a dogmática jurídico-penal passou a dar maior importância ao ofendido pelo fato típico punível. Dessa forma, buscou absorver parte dos conceitos elaborados dentro da criminologia, dogmatizando a relevância da figura na parte geral e especial dos códigos penais. O trabalho baseia-se sobretudo nos CP brasileiro e português, os quais assemelham-se principiologicamente. Os reflexos gerados desta adaptação encontram-se, principalmente, no consentimento do ofendido e na teoria da imputação objetiva, com a autocolocação e heterocolocação em perigo.
