The "gender ideology” on courts: a case for the studies on gender and sexuality supported by judicial precedents of the Court of Justice of the State of São Paulo and of the Brazilian Supreme Federal Court

Resumo: This article aims to offer a moral and liberal case for educational politics promoting equality and sexual diversity (by discussing themes such as gender, sexuality, and discrimination, pejoratively entitled “gender ideology”). Supported by the theories of recognition, political liberalism and multiculturalism, the article adopts as methodology the qualitative analysis of bibliography and judicial cases. It analyzes the Court of Justice of the State of São Paulo and the Brazilian Federal Supreme Court’s judicial precedents on the unconstitutionality of Municipal statutes banishing these themes from being taught in schools. The results of this research indicate an inclination in these precedents to consider these disputes as concerning an “ideological pluralism”. On the other hand, based on the mentioned bibliography, the article argues these disputes concern a “pluralism of values” and the promotion of a common good, more accurately citizen’s mutual respect.

Tendo por referencial a teoria moral do liberalismo político, do reconhecimento e do multiculturalismo, o trabalho pauta-se metodologicamente pela análise qualitativa de material bibliográfico e jurisprudência. Para tanto, analisa precedentes do Tribunal de Justiça do Estado de São Paulo e do Supremo Tribunal Federal que declaram a inconstitucionalidade de leis municipais que vedam a abordagem desses temas nas grades escolares. O resultado desta pesquisa indica uma tendência de enquadramento desses litígios em um “pluralismo de ideias”.
