Resumo: This article aims to analyze the applicability of the Rome Statute rules to Brazil, in accordance with the constitutional principles of legal reservation (Art. 5, II and XXXIX, of Brazilian Constitution) and the non-retroactivity of criminal law (Art. 5, XL, of Brazilian Constitution). Considering as main object the Special Appeal 1.798.903/RJ judgement, in which the leading cases of the Brazilian Supreme Court were raised, this article aims to answer the following questions: can we consider the rules in Articles 7 and 29 of the Rome Statute applicable in Brazil? Is this country violating Articles 86 and 88 of the Rome Statute? The content is divided into three parts, in which, respectively, the evolution of jurisprudence on the subject is described; then, the doctrinal vision concerned is exposed; and, finally, a tertium quid position is supported.

Tendo como objeto principal o julgamento do Recurso Especial nº 1.798.903/RJ, no qual os precedentes do Supremo Tribunal Federal foram suscitados, busca-se resposta aos seguintes questionamentos: seria possível considerar que as normas previstas nos artigos 7º e 29 do Estatuto de Roma são aplicáveis no Brasil? O país está violando os artigos 86 e 88 do Estatuto de Roma?
