Education in Covid-19 times: the reflection between fundamental duties and civil disobedience in the background context of presential classes

Resumo: This article proposes an analysis of the institute of civil disobedience through the external reality of late-capitalism countries and their path to plan and execute emancipatory public policies to fight social inequalities experienced in the face of government abuses and legislation considered to be unjust. Although not specified in the Brazilian legal framework, it concerns a direct instrument of democracy, as revealed in people’s moral choices in defense of democracy; for instance, the dilemma that teachers in Brazilian private schools faced when, even though vaccination rates were very low, among other uncertainties, they had to return to in-person classes during the Covid-19 crisis. The dialectical method with a qualitative approach was chosen. A bibliographical review and analysis of court rulings based on moral principles to support people’s claims regarding the status of human rights in Brazil were conducted.

Embora não positivado no ordenamento jurídico brasileiro, trata-se de instrumento direto de democracia, que se desvela a partir de práticas morais do povo em defesa da democracia a exemplo do dilema vivenciado por professores da rede privada na questão da volta às aulas presenciais, em meio à baixa vacinação da população, entre outras incertezas, em torno da Covid-19.
