Tendo por base a doutrina e jurisprudência brasileiras, os autores discorrem sobre o desenvolvimento histórico do instituto e sobre alguns de seus princípios norteadores, considerando, ainda, as ponderações da doutrina ambientalista. A discussão sobre o estabelecimento de uma nova ética ambiental passa por importantes ponderações da antropologia econômica, o que fundamenta o estabelecimento da solidariedade humana enquanto princípio fundante do próprio Direito Ambiental como ramo de tutela dos direitos acima expostos. Especificamente sobre a legitimidade para a utilização da Ação Popular, disserta-se sobre o amplo cabimento e os fundamentos jurídicos para tal, refutando-se alguns dos posicionamentos contrários.This article discuss about institute of Popular Writ and its use for the protection of the right to a healthy environment and a healthy quality of life. Based on the Brazilian doctrine and jurisprudence, the authors discuss the historical development of the institute and about some of its guiding principles, also considering the considerations of environmentalist doctrine. The discussion on the establishment of a new environmental ethic undergoes significant ponderations of economic anthropology, which underlies the establishment of human solidarity as a founding principle of the environmental law as a branch of protection of the rights set out above.
