Rights of Nature in the Constitutionalisms of the Global South: some reflections from the theory of legal formants

Resumo: Many legal systems in the South of the world have granted legal personality to natural elements, by constitutional, statutory or jurisprudential means. In this article, the phenomenon is analyzed in the light of the theory of legal formants by Rodolfo Sacco. The author wonders if it is possible to consider Nature as a formant, but this implies overcoming the difficulty in defining the concepts of nature and culture. On the basis of the conceptual instruments of the anthropology of nature, the article, on the one hand, questions the use of the expression “cultural formant” in relation to the rights of nature; on the other hand, argues that a monist reading of the relationship between human beings and nature should push Western legal thinking towards a paradigm shift.

En este articulo, el fenómeno se analiza a la luz de la teoría de los formantes de Rodolfo Sacco: la autora se pregunta si es posible considerar la Naturaleza como formante, pero esto implica superar la dificultad en definir los conceptos de naturaleza y cultura. Basándose en los instrumentos conceptuales de la antropología de la naturaleza, el artículo, por un lado, cuestiona la utilización de la expresión “formante cultural” en relación con los derechos de la naturaleza; por otra parte, sostiene que una lectura monista de la relación entre el ser humano y la naturaleza debería impulsar el pensamiento jurídico occidental hacia un cambio de paradigma.Diversos sistemas legais do Sul Global têm concedido personalidade jurídica a elementos da natureza seja por meio constitucional, infraconstitucional ou mesmo jurisprudencial.
