Resumo: | The present work aims to describe the environmental licensing process in indigenous lands and, for that purpose, it used the deductive analytical method, and used the legislation on the subject, as well as research on the website of the agencies involved. It was observed that the environmental licensing is three-phase, that is, three environmental licenses are necessary to be able to operate an enterprise, and that its administrative, discretionary, participative process, having as principle the prevention and disciplined by federal norms. When comparing environmental licensing in the interior of indigenous lands, the time to obtain it far exceeds the time disciplined in the norms, considering that the time for preparation, analysis, diagnosis and participation in the interior of indigenous lands does not meet the dictates of the regulations exist, but allow for their real participation. However, the effective participation of indigenous peoples does not guarantee that the projects will promote the effective protection of the community, hence the need for monitoring by the Federal Public Ministry to safeguard the rights of indigenous peoples. |
