Resumo: The present work aims to describe the environmental licensing process in indigenous lands and, for that purpose, it used the deductive analytical method, and used the legislation on the subject, as well as research on the website of the agencies involved. It was observed that the environmental licensing is three-phase, that is, three environmental licenses are necessary to be able to operate an enterprise, and that its administrative, discretionary, participative process, having as principle the prevention and disciplined by federal norms. When comparing environmental licensing in the interior of indigenous lands, the time to obtain it far exceeds the time disciplined in the norms, considering that the time for preparation, analysis, diagnosis and participation in the interior of indigenous lands does not meet the dictates of the regulations exist, but allow for their real participation. However, the effective participation of indigenous peoples does not guarantee that the projects will promote the effective protection of the community, hence the need for monitoring by the Federal Public Ministry to safeguard the rights of indigenous peoples.

Se observó que el licenciamiento ambiental es trifásico, es decir, son necesarias tres licencias ambientales para que se pueda operar un emprendimiento, y su proceso administrativo, discrecional, participativo, teniendo como principio la prevención y sanción por reglas federales. Al comparar el licenciamiento ambiental en el interior de las tierras indígenas, el tiempo para obtenerlo supera mucho el tiempo disciplinado en las reglas, considerando que los tiempos de preparación, análisis, diagnóstico y participación en el interior de las tierras indígenas no cumplen con los exigencias de los que estan dictados de las reglas actuales, pero que permitan su participación efectiva. Su participación efectiva, sin embargo, no garantiza que los emprendimientos en que ellos participen, les aseguren la protección efectiva de la comunidad, de ahí la necesidad de un seguimiento por parte del Ministério Público Federal de Brasil para garantizar los derechos de los pueblos indígenas.O presente trabalho tem por objetivo descrever o processo de licenciamento ambiental em terras indígenas e para tanto empregou o método analítico dedutivo, e utilizou-se da legislação sobre o assunto, bem como da pesquisa no site dos órgãos envolvidos. Observou-se que o licenciamento ambiental é trifásico, ou seja, são necessárias três licenças ambientais para se poder operar um empreendimento, e que seu processo administrativo, discricionário, participativo, tendo como princípio a prevenção e disciplinado por normas federais. Ao compararmos o licenciamento ambiental no interior de terras indígenas, o tempo para sua obtenção supera em muito o tempo disciplinado nas normas, tendo em vista que o tempo de preparo, análise, diagnóstico e participação no interior de terras indígenas não atendem os ditames dos regramentos existentes, porém permitem sua real participação.
