The Potentialities and Limits of Contemporary Public International Law: an analysis of the blockade imposed on Cuba by the United States

Resumo: This paper analyzes the blockade imposed by the United States of America on Cuba, considering the principles of international law regarding sovereignty, self-determination and non-intervention. To this end, it discusses how these elements constitute a fundamental mark for the development of contemporary public international law. Then, it analyzes the origin and the improvement, over the years, of such policy until reaching, in the 90's, its most recent formulation and elaborated in the Torricelli and Helms-Burton acts. Finally, it analyzes the effects of the blockade and the contrary reaction of the international community, demonstrating that it is constituted as a violation of the basic principles of Public International Law and one of the main obstacles to the effective normalization of relations between Cuba and the United States (USA).

En seguida, analiza el origen y perfeccionamiento, durante los años, de tal política, hasta alcanzar, en los años 90, su formulación más reciente y elaborada en las leyes Torricelli y Helms-Burton. Finalmente, analiza los efectos del bloqueo y la reacción contraria de la comunidad internacional, demostrando que este se constituye como una violación de los principios básicos del Derecho Internacional Público e en uno de los principales obstáculos para la normalización efectiva de las relaciones entre Cuba y los Estados Unidos de América (EEUU).Este trabalho analisa o bloqueio imposto pelos Estados Unidos da América a Cuba, considerando os princípios do Direito Internacional relativos à soberania, autodeterminação e não intervenção. Para tanto, discute como tais elementos se constituem numa marca fundamental para o desenvolvimento do Direito Internacional Público contemporâneo. Em seguida, analisa a origem e o aprimoramento, ao longo dos anos, de tal política até alcançar, nos anos 90, sua formulação mais recente e elaborada nas leis Torricelli e Helms-Burton.
