Resumo: The article aims to investigate the legal implications of the inclusion of pre-exposure prophylaxis (PrEP) in the SUS by presenting the right to health as a fundamental right, inserting the discussions of “risk group” and possible reserve; situate sexual rights from HIV and STIs; analyze the restrictions on the implementation of PREP based on silences. Technology represents a mechanism that ensures the right to health in the preventive aspect, so that it is protected by the prohibition of social retrogression. The regulation of this preventive public policy has legal effects that should not be ignored, including the incorporation of this aspect of the right to prevention as a fundamental right to health. The importance of the article lies in the visibility of LGBT+ population agendas and agencies

A tecnologia representa mecanismo assegurador do direito à saúde na vertente preventiva, de modo que está protegida pela vedação do retrocesso social. A normatização dessa política pública preventiva tem efeitos jurídicos que não devem ser ignorados, dentre eles a incorporação dessa vertente do direito de prevenção enquanto direito fundamental à saúde.
