Resumo: This research intends to analyze the way how Fortaleza municipality dealt with the Special Zones of Social Interest (ZEIS) type 3, during the first ten years of existence of the Participative Master Plan (PDPFor) of Fortaleza. By studying the legal regulamentation of ZEIS type 3, the type of ZEIS created to give use to vacant land, this paper intends to provide an explanation for how ZEIS type 3 in Fortaleza was made impracticable through the actions of the municipal Public Power itself, thus this research show how the municipality of Fortaleza sabotaged it’s own instrument of urban policy. The conclusion here presented is that Fortaleza municipality, which currently goes through the review process of the city’s master plan, will not strive to implement ZEIS type 3, but rather will favor an urban policy that is distant from the ideals that the PDPFor embodies.

A partir da análise da regulamentação legislativa das ZEIS do tipo 3, as chamadas ZEIS de vazio, e das razões relacionadas à não implementação desse instrumento de política urbana e regularização fundiária em Fortaleza, busca-se compreender como foi possível o esvaziamento das ZEIS 3 por meio da própria atuação institucional do município, ou seja como a institucionalidade municipal sabotou o próprio instrumento que deveria implementar.
