Resumo: This investigation sought to portray the Black praxis of the enslaved against the legal system of control and repression during slavery, through the method of critical fabulation. From the tensioning of documentary remnants, news, official communications, records, and maps found in official archives, critical fabulation is employed as a method of historical revision and vocalization against attempts to de-personify Black individuals in history. To this end, based on the announcements of "escaped slaves” between 1838 and 1888 in the newspapers of Sergipe, hosted in the Digital Hemeroteca, four stories of black resistance will be fabulated, showcasing their varied and sophisticated survival strategies against the legal framework of capture. It is concluded regarding the potential of critical fabulation in rescuing the dynamics of enslaved resistance, as well as in critiquing and reconstructing the field of legal historiography.

Esta investigación buscó retratar la praxis negra de los esclavizados contra el sistema jurídico de control y represión durante la esclavitud, utilizando el método de la fabulación crítica. A partir del análisis de documentos fragmentados como noticias, oficios, expedientes y mapas en los archivos oficiales, se utiliza la fabulación crítica como método de revisión histórica y de expresión contra los intentos de despersonalizar a las personas negras en la historia. Para ello, se fabularán cuatro historias de resistencia negra, basadas en los anuncios de "fugas de esclavizados" entre 1838 y 1888 en los periódicos de Sergipe, alojados en la Hemeroteca Digital. Estas historias mostrarán las diversas y sofisticadas estrategias de supervivencia de los esclavizados frente al marco jurídico de captura. Se concluye sobre el potencial de la fabulación crítica para rescatar las dinámicas de resistencia de los esclavizados, así como para realizar críticas y reconstrucciones en el campo de la historiografía jurídica. Essa investigação buscou retratar a práxis negra dos escravizados contra o sistema jurídico de controle e de repressão, durante a escravidão, através do método da fabulação crítica. Do tensionamento sobre os retalhos documentais, as notícias, os ofícios, os autos, os mapas presentes nos arquivos oficiais, insere-se a fabulação crítica como um método de revisão histórica e de vocalização contra as tentativas de despersonificação das pessoas negras na história. Para tanto, a partir dos anúncios de “fugas de escravizados”, entre 1838 e 1888, nos jornais de Sergipe, hospedados na Hemeroteca Digital, serão fabuladas quatro histórias da resistência negra, suas variadas e sofisticadas estratégias de sobrevivência contra o arcabouço jurídico de captura. Conclui-se sobre a potencialidade da fabulação crítica no resgate das dinâmicas resistências dos escravizados, bem como sobre críticas e reconstruções no campo da historiografia jurídica.
