Racialized territories and the production of risk of domestic violence by the Justice System

Resumo: This article suggests the existence of a racializing process wich colonizes the perception of justice system actors about violent urban territories. The understanding of communities near Sobradinho-DF - that essentializes black lives as the violent and uncivilized "other" -takeseffect in the black women's experience of justice next to the network to combatdomestic violence. This process produces a risk of violence uncaptureable by the public politic of the National Domestic Violence Risk Assessment Form (Law 14.149/2021). The socio-spacial patterns segregation that characterize racial inequalities define experiences of justice, especially in the relationship between victims and the police. The dispossession of citizenship of black woman in Brazil is also produced by the Judiciary in its daily practices and legal discourses.

Este artículo sugiere que existe un proceso de racialización que coloniza la percepción de los actores del sistema de justicia sobre los territorios urbanos violentos. La comprensión de las comunidades cercanas a Sobradinho-DF - que esencializa las experiencias negras como el "otro" violento e incivilizado - tiene un efecto sobre la experiencia de justicia de las mujeres negras dentro de la red de violencia doméstica. Este proceso produce un riesgo de violencia que no puede ser captado por la política pública del Formulario Nacional de Evaluación de Riesgo de Violencia Doméstica (Ley 14.149/2021). Los patrones de segregación socioespacial que caracterizan las desigualdades raciales definen las experiencias de justicia, especialmente en la relación entre las víctimas y la policía. La desposesión de la ciudadanía de las mujeres negras en Brasil también es producida por el poder judicial en sus prácticas cotidianas y discursos jurídicos. Este artigo sugere que há um processo racializador que coloniza a percepção dos atores do sistema de justiça sobre territórios urbanos violentos. A compreensão de comunidades próximos à Sobradinho-DF – que essencializa vivências negras como o “outro” violento e incivilizado - produz efeitos na experiência de justiça de mulheres negras junto à rede de enfrentamento à violência doméstica. Esse processo produz um risco de violência incapturável pela política pública do Formulário de Nacional de Avaliação de Risco de Violência Doméstica (Lei n. 14.149/2021). Os padrões de segregação socioespacial que caracterizam as desigualdades raciais definem experiências de justiça, sobretudo na relação das vítimas com a polícia. A desapropriação da cidadania de mulheres negras no Brasil também é produzida pelo Poder Judiciário em suas práticas cotidianas e discursos jurídicos.
