Critical analysis of the new law 21.030 on abortion in Chile, from the mapuche culture and the gender decolonial theory

Resumo: Law N°. 21.030 of September 30th 2017 introduced new regulation in Chile regarding the decriminalization of abortion under three specific grounds. In that context, this work aims to address the regulation of abortion in Chile and the recent legal modification from both a Decolonial gender perspective and Mapuche women necessities. To this effect, we approach to the Mapuche culture view on abortion, before the Spanish colony, and today. Then, once the coloniality of the abortion legislation in Chile is pointed out, and the juridical-colonial framework is established, we analyse the latest legal reform on abortion, Law Nº. 21.030, and how it affects Mapuche women. To do so, we follow an interdisciplinary methodology, combining the use of anthropological studies, Decolonial theory and legal penal analysis.
