Individualized voices, blurred groups: Copyright conflicts and Mapuche poetry in Chile

Resumo: The Mapuche people are one of the most important «native people» of the American continent, due to the number of members, and their strong resistance to nations that they have not recognized as their own (Spain, first, and Chile and Argentina later). In this dichotomous process of integration and resistance, the transmission of values ​​and cultural elements generation after generation has been fundamental to preserve a common cultural base. However, the cultural expressions of the Mapuche people do not find accommodation in the rigid legal structures of present-day Chile, whose regulations (in the image and likeness of the European) do not contemplate any other mode of artistic creation than the individual. This article tries to show the incompatibility of copyright regulations to effectively collect, protect and disseminate Mapuche poetic speeches while preserving the logic of collective and community membership present in the genesis of those speeches.
