An urgent discussion: the possibilities of black youth in the Brazilian world of labor from the perspective of intersectionality and critical legal-labor theory

Resumo: The present work aims to investigate the conditions of young black Brazilians in the world of labor. There are several studies addressing the situation of Brazilian black youth in the areas of education, criminal, cultural, sports. However, there is little exploration in the scientific field of notes about employability, existing possibilities and their current conditions. In this sense, it is opportune to examine the hypothesis that, in the world of work, there is a reproduction of Brazilian racism, leaving this population to remain informal, work analogous to slavery and, when there is a possibility of formality, occupation of the most demanding professions dangerous. Based on theoretical reflections arising from the Critical Social Theory of Labor Law and Intersectionality, a qualitative and quantitative analysis of official census data was carried out, addressing the rescue of workers in conditions similar to slavery and with a greater number of accidents work to prove the hypothesis. That way, based on the intersectionality between age, gender, race and class, it can be concluded that the black population, especially black youth and women, is the most vulnerable.

El presente trabajo tiene como objetivo investigar las condiciones de los jóvenes negros brasileños en el mundo del trabajo. Hay varios estudios que abordan la situación de la juventud negra brasileña en las áreas de educación, penal, cultural, deportiva. Sin embargo, existe poca exploración en el ámbito científico de apuntes sobre la empleabilidad, las posibilidades existentes y sus condiciones actuales. En ese sentido, es oportuno examinar la hipótesis de que, en el mundo del trabajo, se reproduce el racismo brasileño, dejando a esa población en la informalidad, trabajo análogo a la esclavitud y, cuando existe la posibilidad de formalidad, ocupación de las profesiones mas exigentes peligrosas. A partir de reflexiones teóricas surgidas de la Teoría Social Crítica del Derecho del Trabajo y la Interseccionalidad, se realizó un análisis cualitativo y cuantitativo de datos censales oficiales, abordando el rescate de trabajadores en condiciones similares a la esclavitud y con mayor número de accidentes laborales para comprobar la hipótesis. Así, a partir de la interseccionalidad entre edad, género, raza y clase, se puede concluir que la población negra, especialmente los jóvenes y mujeres negros, es la más vulnerable. O presente trabalho tem por objetivo averiguar as condições do jovem negro brasileiro no mundo do trabalho. Há diversas pesquisas abordando a situação da juventude negra brasileira nas áreas da educação, penal, cultural, esportiva. Entretanto, constata-se uma reduzida exploração no campo científico de apontamentos acerca da empregabilidade, as possibilidades existentes e suas atuais condições. Nesse sentido, é oportuno o exame da hipótese de que, no mundo do trabalho, há uma reprodução do racismo brasileiro, restando a essa população a informalidade, o trabalho análogo à escravidão e, quando existe a possibilidade da formalidade, a ocupação das profissões mais perigosas. Fundamentado a partir das reflexões teóricas provenientes da Teoria Social Crítica do Direito do Trabalho e da Interseccionalidade, realizou-se uma análise qualitativa e quantitativa de dados de censos oficiais abordando o regaste de trabalhadores em condições análogas à de escravo e com maior número de acidentes de trabalho para comprovação da hipótese. Dessa forma, a partir interseccionalidade entre idade, gênero, raça e classe, pode-se concluir de que a população negra, especialmente a juventude negra e as mulheres, é a mais vulnerabilizada.
