Resumo: The first proposal was to study the insurgent legal practices of social movements in the context of popular legal services carried out by lawyers in Brazil, from 1960 to the present. The thesis is that the legal aid of popular movements contributes to the strengthening of insurgents legal practices. The new question is “How insurgents legal practices make use of the right?”. In this sense it’s stated that the legal practices of popular movements are occasionally insurgents against the State and the right, and can be seen in the course of legal aid of social movements, as in the case of popular lawyers. It deals with the critique of Law based on Karl Marx in order to develop the new concepts of popular legal aid and insurgent law.

Com base na tese de que a assessoria jurídica de movimentos populares contribui para o fortalecimento de práticas jurídicas insurgentes, questiona-se “De que maneira movimentos sociais fazem uso do direito?”. Neste sentido afirma-se que as práticas jurídicas de movimentos populares são ocasionalmente insurgentes em relação ao Estado e ao direito, e podem ser percebidas na trajetória de apoiadores jurídicos de movimentos sociais, como no caso dos advogados populares.
