THE DELIVERERS OF DIGITAL PLATFORMS: JUDICIAL CONTROVERSIES, AUTONOMY, DEPENDENCE AND CONTROL

Resumo: The digital working platforms are the technological expression of the business model of the Fourth Industrial Revolution. In the case of digital delivery work platforms, workers have their social condition demarcated by precariousness and lack of legal protection. In this article, the proposal covers the examination of the context, definition and mode of operation of digital delivery platforms, as well as the in-depth analysis of two conflicting decisions on the quality of the delivery worker as an employee. In the theoretical-conceptual part, the business model of digital platforms, the specific performance of delivery platforms, their standard of organization of economic activity and the working conditions of their deliverers are critically addressed. In the judged part, the critical analysis and the deepening of the concepts of autonomy, subordination and economic dependence in the factual relationship of the delivery platforms were made. For that purpose, the theoretical interdisciplinary review, including foreign, of the subject was used, as well as the documental exploration of the judicial decisions that point or not to the regulation by Labor Law of the existing link between the deliverers and the digital platforms.

No caso das plataformas digitais de trabalho de entregas, os trabalhadores têm sua condição social demarcada pela precariedade e falta de proteção legal. Neste artigo, a proposta abrange o exame do contexto, definição e modo de atuação das plataformas digitais de entregas, bem como a análise detalhada de duas decisões antagônicas sobre a qualidade do entregador como empregado. Na parte teórica-conceitual, aborda-se criticamente o modelo empresarial das plataformas digitais, a atuação específica das plataformas de entregas, seu padrão de organização da atividade econômica e as condições de trabalho dos seus entregadores. Na parte dos julgados, foi feita a análise crítica e o aprofundamento dos conceitos de autonomia, subordinação e dependência econômica na relação fática das plataformas de entregas.
