RACISMO INSTITUCIONAL E POVOS INDÍGENAS: DAS PRÁTICAS ASSIMILADAS ÀS ESTRATÉGIAS DE ENFRENTAMENTO

Resumo: | The article studies the institutional racism present in the Brazilian criminal justice system. In this context, it asks how institutional racism operates against indigenous peoples. In the first item, it analyzes coloniality and racism in the Brazilian criminal justice system, showing an uneven profile between those who judge and those who are judged. The second item, through the analysis of reports from official bodies and civil society organizations, demonstrates how the Brazilian criminal justice system assimilates racism in its practices. In the last item, it discusses possibilities to debate the issue, understanding the Law as part of a racist structure, but also as a tool of resistance, which can be represented by Resolution 287/2019, from CNJ, and Resolution 13/2021, from DEPEN. It concludes that, by perpetuating the integrationist ideal and not considering the specificities inherent to indigenous people, the criminal justice system contributes to ethnocide. Finally, it points to the need to value counter-hegemonic ways of interpreting and applying law, such as those derived from decolonial, anti and post colonial studies. The research has a qualitative character, and uses deductive method, bibliographic review and documentary research. |

Nesse contexto, indaga como o racismo institucional opera contra os povos indígenas. No primeiro item, aborda a colonialidade e o racismo incrustado no sistema de justiça criminal brasileiro, apontando um perfil desigual entre quem julga e quem é julgado. O segundo item, através da análise de relatórios produzidos por órgãos oficiais e organizações da sociedade civil, demonstra como o sistema de justiça criminal brasileiro assimilou o racismo nas suas práticas. No último item, discute possibilidades de enfrentamento da questão, compreendendo que o Direito não é emancipatório, mas os movimentos dos grupos subalternizados que recorrem à lei para dar continuidade a sua secular luta. O conhecimento do Direito é instrumento de empoderamento da sociedade civil, que pode usá-lo para alcançar o acesso a direitos. Mas também, é capaz de ser plano de fundo de reivindicações por transformações, quando não está mais acompanhando as necessidades do povo. Conclui que, ao perpetuar o ideal integracionista e não considerar as especificidades inerentes às pessoas indígenas, o sistema de justiça criminal contribui para o seu etnocídio. Diante disso, aponta a necessidade de valorização de formas contra-hegemônicas de interpretar e aplicar o Direito, como aquelas derivadas de estudos decoloniais, anti e póscoloniais.
