ACCESS TO PATENTS ON MEDICINES OF PUBLIC HEALTH INTEREST IN TIMES OF PANDEMIC

Resumo: | With the adherence to the TRIPS Agreement, Brazil is allowed to use all the flexibilities provided for in the Agreement with a view to accessing the knowledge described in the patents on pharmaceutical products and processes, especially medicines, considered of interest for public health policies with intent to curb abuses of the exercise of the right conferred by the patent, especially by the pharmaceutical industry. The study shows that the legislation in force in Brazil provides tools that enable access to technologies of interest to public health, through voluntary or compulsory licenses, priority examination of patent applications and presentation of subsidies to the examination, however, in the context of coping with pandemic of Covid-19, several bills were proposed to change legislation with the intention of expanding the scope of coverage of compulsory licenses since the current legislation provides for compulsory licensing only for patents granted, so that it excludes patent applications under INPI's analysis. |
