Resumo: In this research paper we will study the concept and history of patents, as well as the possibility of a “breach” of these in our national law and its main updates in 2021. The discussion gains greater repercussion given the huge COVID-19 crisis that has spread around the world, but has also always been present, especially in the pharmaceutical industry. We also have the presentation of legal cases, the only case of Brazilian compulsory license, and the existence of licenses abroad. In addition, the possible consequences that this institute would cause in Brazil and in the world will be analyzed
