The impasse between the protection of the environment and the repression of protectionist policies in the Dispute Settlement Body of the WTO

Resumo: Since the entry into force of the World Trade Organization (WTO) in 1995, its Dispute Settlement Body (CSO) has dealt with a large number of disputes involving trade measures relating to the protection of the environment. These measures reach a variety of policies, ranging from the conservation of marine species to the protection of human health against risks caused by the circulation of products and pollution. From that point on, the study uses the deductive method to emphasize that CSOs have been giving coherent treatment to the protection of the environment when confronted with the economic matter that is the subject of the main protection, provided that the environmental restriction is not used as a mere protectionist policy, in a which demonstrates the WTO's commitment to sustainable development while promoting the removal of barriers to global free trade.

A hipótese deste estudo é a de que a OMC pode colaborar para a consecução do desenvolvimento sustentável, quando da apreciação de políticas nacionais de salvaguarda ambiental, que vão desde a conservação de espécies marinhas até a proteção da saúde humana, contra riscos causados pela circulação de produtos e pela poluição. O objetivo deste estudo, a seu turno, é analisar como a tratativa do meio ambiente, no Órgão de Solução de Controvérsias da OMC, pode revelar o compromisso da própria organização com o desenvolvimento sustentável, expondo desafios e oportunidades. Para tanto, o estudo se utiliza do método hipotético-dedutivo, aliado ao levantamento bibliográfico e documental. Como resultado, o estudo expõe que as decisões do OSC dão tratamento coerente à proteção do meio ambiente, quando em confronto com a matéria econômica objeto de tutela principal, desde que a restrição ambiental não seja utilizada como mera política protecionista.
