Processes generators of the informal occupation: Case of study in the city of Rio dos Cedros/SC

Resumo: The brazilian urbanization process created gaps of urban segregation, stimulating the occupation of the peripheral areas, even without adequate infrastructure. This cultural urban planning heritage can be seen at the most different regions of the country, which is the case of the present study. This one aim to understand the process generators of the informality in irregular occupations situated in the city of Rio dos Cedros, Santa Catarina. For this, the methodology used was applied in five steps: definition of the core, historical analysis, legal analysis, elaboration of the summary table and timeline, and then the final results. From this, were verified as determining factors the location of the consolidated informal urbans centers, the sales values practiced, the obsolete municipal legislation and the lack of action of the public authorities. Finally, the study points out that, to prevent future illegally occupied areas, one of the tools is the restructuring of municipal public agencies. The city is the key piece to foster legality and act in its supervision, seeking territorial planning and the correct development of the city.

Este patrimonio urbano cultural se puede ver en las más diversas regiones del país, que es el caso del presente estudio. Este trabajo tiene como objetivo comprender los procesos que generan informalidad en las ocupaciones irregulares ubicadas en el municipio de Rio dos Cedros, Santa Catarina. Para ello, se aplicó la metodología en cinco pasos: definición de los núcleos, análisis histórico, análisis jurídico, elaboración de tabla resumen y cronograma, y así los resultados finales. A partir de esto, observamos como factores determinantes la ubicación de centros urbanos informales consolidados, los valores de venta practicados, la antigua legislación municipal y la falta de acción del poder público. Por último, el estudio señala que, para evitar futuras zonas ocupadas de forma irregular, una de las herramientas es la reestructuración de los organismos públicos municipales. El municipio es la pieza clave para fomentar la legalidad y actuar en su supervisión, buscando la planificación territorial y el correcto desarrollo de la ciudad.O processo de urbanização brasileiro criou lacunas de segregação urbana, estimulando a ocupação das áreas periféricas, mesmo sem infraestrutura adequada. Essa herança urbanística cultural pode ser vista nas mais diversas regiões do país, que é o caso do presente estudo. Este visa compreender os processos geradores da informalidade em ocupações irregulares situadas no município de Rio dos Cedros, Santa Catarina. Para isso, a metodologia utilizada foi aplicada em cinco passos: definição dos núcleos, análise histórica, análise legal, elaboração de quadro resumo e linha do tempo, e assim os resultados finais. A partir disto, verificou-se como fatores determinantes a localização dos núcleos urbanos informais consolidados, os valores de venda praticados, a legislação municipal obsoleta e a falta de atuação do poder público. Por fim, o estudo aponta que, para prevenir futuras áreas ocupadas irregularmente, uma das ferramentas é a reestruturação dos órgãos públicos municipais.
