O esporte, como expoente de um chamado direito global, tem a peculiaridade de ser desvinculado à seara governamental e, por tal motivo, permite a sua autonomia jusnormativa. A complexidade estrutural da atividade desportiva, em nível internacional, demandou a criação de entidades especializadas em lidar com esses tipos de litígios, em especial a corte arbitral internacional, a qual unifica, interpreta e aplica as normas e regras referentes aos mais distintos aspectos da prática profissional desportiva. Assim, através da análise de casos concretos e da comparação com o sistema jurídico-desportivo brasileiro, busca-se analisar a atuação do Tribunal Arbitral do Esporte – TAS na resolução de litígios desportivos, sobretudo os que envolvem contratos desportivos. Sport, as an exponent of a so-called global right, has the peculiarity of being disconnected from the government sector and, for this reason, allows its autonomy jusnormativa. The structural complexity of sporting activity at the international level has required the creation of entities specialized in dealing with these types of litigation, in particular the international arbitral tribunal, which unifies, interprets and applies the norms and rules referring to the most different aspects of the practice Professional sports. Thus, through the analysis of concrete cases and the comparison with the Brazilian legal-sport system, we seek to analyze the performance of the Court of Arbitration for Sport - CAS in the resolution of sports disputes, especially those involving sports contracts.
