Como insumo à pesquisa, há embasamento teórico no modelo Português de controle preventivo, no qual há determinação constitucional para apreciação de determinados projetos de lei por parte do Tribunal Constitucional – isto é – a transformação do controle preventivo em controle jurisdicional, além da problematização do caso brasileiro por meio da análise da prática legislativa e executiva. No. of bitstreams: 1 2015_FernandaCristinneRochaDePaula.pdf: 554163 bytes, checksum: 5e84ff7edd6397691afb56510e675c05 (MD5)Starting from the premise that the presidential veto for reasons of unconstitutionality is not a political act, of the discretion of the Chief of the Executive Branch, but a mean to preventively control the constitutionality, the paper aims to discuss the material illegitimacy of the President to analyze legal vetoes, as well as the defense of the institution, in the Brazilian model, of the appreciation of the Brazilian Supreme Court (Supremo Tribunal Federal - STF). As a resource to the survey, theoretical fundaments of the preventive control are provided by the Portuguese model, in which there is a constitutional determination for the appreciation of some given bills by the Constitutional Court – which means – the transformation of the preventive control into jurisdictional control, and the specificity of the Brazilian case, through the analysis of the legislative and executive practices.
