Monografia (Bacharelado em Direito)—Universidade de Brasília, Brasília, 2014.http://bdm.unb.br/handle/10483/8907Monografia (graduação)—Universidade de Brasília, Faculdade de Direito, 2014.O presente estudo teve como principal objetivo analisar o tratamento dispensado atualmente no Brasil ao Trabalho Infantil Artístico (TIA) que, a despeito da proibição constitucional de qualquer trabalho aos menores de 16 anos de idade, contida no art. 7º, inciso XXXIII, da Constituição Federal, vem sendo autorizado com base em normas internacionais, infraconstitucionais e critérios adotados pelos juízes, com principal ênfase na permissão contida no artigo 8º da Convenção n. 138 da OIT, que permite, de forma excepcional, o trabalho infantil em atividades artísticas, mediante licenças concebidas em caráter individual. O tema em si tem gerado bastante controvérsia, pois apesar de ser objeto de um tratamento diferenciado e da atuação das crianças e adolescentes no mundo das artes sofrer de inquestionável deslumbramento, não fica claro se o artista mirim, ao realizar participações artísticas em um empreendimento com finalidades econômicas, não estaria se sujeitando as mesmas pressões e constrangimentos de qualquer outra atividade profissional. Nesses termos, é relevante questionar de maneira crítica os motivos que justificam a autorização judicial e a própria participação dos menores no mundo do espetáculo para determinar se esse tratamento se coaduna com o princípio da proteção integral da criança e do adolescente, contido no artigo 227 da Constituição Federal, salvaguardando aos menores todos os seus direitos, inclusive o direito de ser uma criança e ter uma infância plena. Para esses fins, o presente trabalho se propõe a traçar um panorama geral sobre o trabalho infantil e o trabalho infantil artístico, analisando as causas que os justificam, os dados coletados sobre o assunto e o contexto geral em que é expedida a autorização judicial. ______________________________________________________________________________ ABSTRACTThe present study aimed to analyze the treatment currently dispensed in Brazil Artistic Child Labour (TIA), which despite the constitutional prohibition of any work for persons under 16 years of age, contained in Art. 7, XXXIII of the Federal Constitution, have been authorized based on international, infra and criteria adopted by the judges, with main emphasis on the permission contained in Article 8 of Convention standards. 138 ILO, which allows, exceptionally, child labor in artistic activities, designed by permits on an individual basis. The theme itself has generated a lot of controversy, because despite being subject to differential treatment, and the performance of children and adolescents in the art world suffer from unquestionable amazement, not clear whether the mirim photographer, to make artistic contributions on a development with economic purposes, would not be subject to the same pressures and constraints of other professional activities. In these terms, it is critically important to question the grounds for judicial authorization and the actual participation of minors in the entertainment industry to determine if this treatment is consistent with the principle of integral protection of children and adolescents, contained in Article 227 of Federal Constitution, safeguarding minors all their rights, including the right to be a child and have a full childhood.
