Por meio do Edital nº 2/2014, a Anatel licitou as autorizações de uso da radiofrequência de 700 MHz, a ser utilizada pelas licitantes vencedoras para oferecer Serviço Móvel Pessoal – SMP 4G com maior área de cobertura e menor custo. O mesmo Edital atribui às empresas vencedoras a responsabilidade por limpeza dessa faixa, hoje ocupada pela radiodifusão analógica de sons e imagens (TV analógica), devendo adotar as medidas necessárias para mitigar as interferências prejudiciais entre os sinais de TV Digital e o 4G. Para implementar essas medidas, o Edital inova ao estabelecer a repartição de competências entre a Entidade Administradora do Processo de Redistribuição e Digitalização de Canais de TV e RTV – EAD, constituída pelas licitantes vencedoras, e o Grupo de Implantação do Processo de Redistribuição e Digitalização de Canais de TV e RTV – GIRED, integrado pelo governo, empresas vencedoras e partes interessadas. Basicamente, compete ao GIRED definir diretrizes e decidir as grandes questões do processo de limpeza da faixa, sem adentrar nas decisões táticas (como fazer) e operacionais (o que fazer), que competem à EAD, entidade criada pelas licitantes vencedoras para esse propósito específico. O presente trabalho adota como paradigma o modelo de Regulação Responsiva, conforme conceituado por Ayres e Braithwaite (1992), mediante o qual se sustenta que a efetividade da regulação depende da criação de regras que incentivem o regulado a cumpri-las voluntariamente, mediante um ambiente regulatório de constante diálogo entre regulador e regulado. Ao final, conforme resultados esperados, conclui que existem elementos de Regulação Responsiva identificados na prática institucional da Anatel, verificados no caso concreto na condução do referido procedimento licitatório do 4G em 700Mhz e nas primeiras decisões do GIRED. _____________________________________________________________________________ ABSTRACTThis work seeks, through the analysis of the sectoral dialogue construction process, identify Responsive Regulatory elements in the work of the Agência Nacional de Comunicações - Anatel on the 4G Personal Mobile Service. Through the Notice nº 2/2014, Anatel auctioned the 700 MHz radio frequency use authorizations, to be used by the winning bidders to provide Personal Mobile Service - SMP 4G with a larger area coverage and lower costs. The same Notice attaches to the winning companies the responsibility for cleaning this range of frequency, nowadays occupied by analogue sounds and images (analog television), and for taking the necessary measures to mitigate harmful interference between digital TV signals and 4G. To implement these measures, the Notice innovates by establishing the share of responsibilities between the Entidade Administradora do Processo de Redistribuição e Digitalização de Canais de TV e RTV – EAD, constituted by the winning bidders, and the Grupo de Implantação do Processo de Redistribuição e Digitalização de Canais de TV e RTV – GIRED, integrated by the government, winning companies and stakeholders. Basically, it is the GIRED’s competence to set guidelines and decide major issues about the band cleaning process without interfering in the tactical (how to do) and operational (what to do) decisions, that competes to EAD, an entity created by the winning bidders for this specific purpose . This paper adopts the paradigm the Responsive Regulation model as conceptualized by Ayres and Braithwaite (1992), by which it is claimed that the effectiveness of regulation depends on creating rules that encourage the regulated to voluntarily comply with the regulatory policy, in a regulatory environment of permanent dialogue between the regulator and regulated firms.
