Para isso foi realizada uma pesquisa em toda a legislação que disciplina a preservação do meio ambiente, o desenvolvimento econômico e social e os incentivos fiscais concedidos a segmentos da sociedade no DF, o que permitiu uma comparação entre esses segmentos e o de recicláveis. A justificativa para a realização do trabalho se deve à grande preocupação de setores da sociedade civil organizada com o crescimento populacional nas grandes cidades e suas conseqüências. A falta de definição de uma Política Nacional para os Resíduos Sólidos com diretrizes para gestão do lixo e a incorporação de incentivos ao segmento de reciclagem tem deixado a sociedade à mercê dos interesses individuais e temporários. O lixo descartado pelas cidades se transformou em sério problema, sob os mais variados aspectos, principalmente no tocante à manutenção da saúde da população e preservação do meio ambiente. Ao mesmo tempo em que o lixo é fonte de riqueza para alguns, que absorvem dois terços dos ganhos com a reciclagem e lucram grandes somas com a coleta pública, ele também é meio de sobrevivência para muitos. No Distrito Federal, as associações e cooperativas de catadores e seus associados não são capazes de manter as condições mínimas de vida que prevê a Lei Maior, não têm capacidade contributiva. A cobrança de imposto sobre a matéria-prima reciclada, reutilizada na produção, caracteriza uma bitributação e vai no sentido contrário do desenvolvimento sustentável. A atividade de reciclagem é hoje responsável pela geração de milhares de postos de trabalho e a inserção de cidadãos e cidadãs, alijados do mercado de trabalho e marginalizados pela sociedade. Somam-se a esses aspectos outros, com a mesma importância, como a economia de energia, de água, da matéria virgem para produção de novos bens e, principalmente, a preservação do meio ambiente. Diante do quadro apresentado, este trabalho conclui recomendando a mobilização da sociedade para reivindicar aos poderes legislativos e aos governantes a adoção de medidas urgentes que estabeleçam políticas públicas e diretrizes para gerenciamento dos resíduos sólidos, que contemplem o interesse social e que priorizem a preservação do meio ambiente. For this the legislation was carried through a research in all that disciplines the preservation of the environment, the economic and social development and the tax incentives granted the segments of the society in the capital of Brazil, what it allowed a comparison between these segments and of recycles. The justification for the realization of the work if must to the great concern of sectors of the civil society organized with the population growth in the great cities and its consequences. The lack of definition of one National Politics for the Solid Residues with lines of direction for management of the garbage and the incorporation of incentives to the recycling segment has left the society at the mercy of the individual and temporary interests. The discarded garbage for the cities if transformed into serious problem, under the most varied aspects, mainly in regards to the maintenance of the health of the population and preservation of the environment. At the same time where the garbage is source of wealth for some, that absorb two parts in three of the profits with the recycling and profit great additions from the public collection, it also he is half of survival for many. In the capital of Brazil, the associations and cooperatives of collecters and its associates are not capable to keep the minimum conditions of life that foresees the Law Biggest, do not have tax-paying ability. The collection of tax on the recycled raw material, reused in the production, characterizes a doble taxation and goes in the contrary direction of the sustainable development. The activity of recycling is today responsible for the generation of thousand of work ranks and the insertion of citizens, unloaded of the market of work and kept out of society by the society. These aspects are added it others, with the same importance, as the economy of energy, water, the virgin substance for production of new goods and, mainly, the preservation of the environment. Ahead of the presented picture, this work concludes recommending the mobilization of the society to demand to them legislative and the governing the adoption of urgent measures that define public politics and lines of direction for management of the solid residues, that contemplate the social interest and that they prioritize the preservation of the environment.
