A análise das alterações na estrutura de produção que geram a precarização da mão-de-obra trabalhadora também é essencial para a compreensão da crise de representação vivida pelos sindicatos que, organizados a partir da clássica conformação das grandes fábricas do período fordista, encontram dificuldades para fixar uma atuação representativa e democrática em meio a uma base trabalhadora fragmentada pelos diferentes tipos de contrato de trabalho (que têm como consequência diferentes condições de trabalho). Em um contexto de alterações legislativas que legitimam as modificações na estrutura de produção, com vistas ao aumento de lucro, importa-se encontrar saídas benéficas ao trabalhador dentro do próprio texto legislativo, adequando-se a interpretação da legislação ordinária aos preceitos constitucionais de modo que retrocessos sociais como o alargamento da possibilidade de terceirização não inviabilizem o direito do trabalhador a participar e ser representado por um sindicato que converta os interesses da base em agenda de atuação sindical. Nesse sentido, por meio de uma revisão bibliográfica e recolhimento de dados que refletem o atual cenário do mercado de trabalho, é feita uma discussão sobre a atuação sindical no contexto em que a terceirização pode ser estendida à atividade-fim, por meio de um diálogo entre a legislação e a necessidade de uma representação que vá além dos aspectos formais para ser factualmente efetiva. The analysis of the changes in the structure of production that generate the precariousness of the labor force is also essential for the understanding of the crisis of representation experienced by the unions, which were organized from the classic conformation of the great factories of the Fordist period and have difficulty establishing a representative and democratic performance in the midst of a fragmented working force given the different types of labor contract (which have as a consequence different working conditions). In a context of legislative changes that legitimize modifications in the production structure, aiming at increasing profits, it is important to find benefits that are beneficial to the worker within the legislative text itself, adapting the interpretation of ordinary legislation to constitutional precepts so that social backslides such as the extension of the possibility of outsourcing do not prevent the right of the worker to participate in and be represented by a union that converts the interests of the base into an agenda for trade union. Through a bibliographical review and data collection that reflect the current labor market scenario, a discussion is made of the trade union activity in the context in which outsourcing can be extended to the end-activity, through a dialogue between the legislation and the need for a representation that goes beyond formal aspects to be factually effective.
