O presente estudo pretende explorar o prequestionamento e as mudanças trazidas pelo diploma processual por meio de pesquisa bibliográfica e documental. Malgrado a Constituição Federal não faça referência expressa ao instituto, o prequestionamento tem fundamento nas normas constitucionais que versam sobre o cabimento de recurso excepcional aos Tribunais Superiores. Contudo, a consagração do prequestionamento ficto pelo Código de Processo Civil, apesar de indicar maior segurança jurídica e efetividade na prestação jurisdicional, não só é incompatível com a Constituição Federal como contraria a jurisprudência que vinha sendo praticada nos Tribunais Superiores. The present study intends to explore the prequestionamento and the changes brought by the procedural document through bibliographical and documentary research. Although the Federal Constitution does not refer expressly to the institute, the prequestionamento is based on the constitutional norms that deal with the possibility of an exceptional appeal to the Superior Courts. However, the fictitious prequestionamento adopted by the Code of Civil Procedure, despite indicating greater legal certainty and effectiveness of the judicial process, is not only incompatible with the Federal Constitution, but also contrary to the jurisprudence that has been practiced in the Superior Courts.
