Isso só é possível olhando para o passado e aprendendo com a história das Cortes Supremas do Brasil. Em um primeiro momento, será analisada a famigerada “crise” que assola esses tribunais superiores e quais foram as medidas tomadas para solucioná-la. Em seguida, faz-se um estudo da repercussão geral, já que esse procedimento inspirou o surgimento da Proposta de Emenda à Constituição que visa a criar o filtro da relevância, ora em análise. Depois, examina-se a realidade do Superior Tribunal de Justiça e quais os passos que o levaram à situação caótica em que ele se encontra. That is only possible by looking to the past and learning from the history of the Brazilian Supreme Courts. At first, the infamous crisis which haunts these courts and the measures taken to settle it will be analyzed. Then, an examination about the general repercussion is made, whereas this procedure inspired the development of the Proposed Constitutional Amendment in analysis. Subsequently, the situation of the Superior Court of Justice will be analyzed, along with the process which took it to the chaotic state it is in.
