Regulatory Framework to Combat Fake News in Brazil: an analysis of legislative proposals

Resumo: | The objective of this research is to analyze the bills that are being processed in the National Congress that concern the fight against fake news in Brazil. Especially since the 2018 elections, and even more so with the 2022 elections, the debate on the subject has been intensifying, as well as the establishment of mechanisms for the mass production and reproduction of this false content with the intention of confusing Brazilians with respect to topics of paramount importance to the country, such as the treatment for Covid-19. To carry out this analysis, we used as a methodological procedure the Content Analysis, by Laurence Bardin (1977), to analyze the 50 bills, which were being processed in the Chamber and the Federal Senate, until 2021, highlighting in these projects the following aspects: thematic; concept; vocation for prevention or criminalization. As main results, it was found that most of the bills were built from the year 2020. It was also identified that there is a consensus regarding the concept of fake news, in such projects, which concerns fake news with the intention of causing harm. Most of the projects analyzed were linked to the topic of Covid-19 or the topic of elections, showing how these issues are sensitive and must be protected from the damage that false news can cause. Finally, most of these bills do not find a solution to the issue of fake news other than criminalization, other aspects that could be considered, such as education for the prevention and confrontation of this phenomenon, are almost never mentioned. |

Especialmente desde las elecciones de 2018, y más aún con las elecciones de 2022, el debate sobre el tema se ha ido intensificando, así como el establecimiento de mecanismos para la producción y reproducción masiva de contenido falso con la intención de confundir a los brasileños con respecto a temas de suma importancia para el país, como el tratamiento del Covid-19. Para realizar esta investigación, utilizamos como procedimiento metodológico el Análisis de Contenido, de Laurence Bardin (1977), para analizar los 50 proyectos de ley, que estaban en trámite en la Cámara y el Senado Federal, hasta 2021, destacando en estos proyectos los siguientes aspectos: temática; concepto; vocación por la prevención o la criminalización. Como principales resultados se encontró que la mayoría de los proyectos de ley fueron construidos a partir del año 2020. También se identificó que existe un consenso en cuanto al concepto de fake news, en dichos proyectos, que se refiere a noticias falsas con la intención de causar daño. La mayoría de los proyectos analizados estuvieron vinculados al tema del Covid-19 o al tema de las elecciones, mostrando cómo estos temas son sensibles y deben ser protegidos del daño que pueden causar las noticias falsas. Finalmente, la mayoría de estos proyectos de ley no encuentran una solución al tema de las noticias falsas más allá de la criminalización, casi nunca se mencionan otros aspectos que podrían considerarse, como la educación para la prevención y el enfrentamiento de este fenómeno.O objetivo dessa pesquisa é analisar os projetos-lei que estão tramitando no Congresso Nacional que dizem respeito ao enfrentamento das fake news no Brasil. Especialmente, desde as eleições de 2018, e mais ainda com as eleições de 2022, vem adensando-se o debate sobre o tema bem como o estabelecimento de mecanismos de produção e reprodução em massa desse conteúdo falso com a intenção de confundir os brasileiros com respeito a temas de suma importância para o país, tal como o tratamento para a Covid-19. Para fazer esta análise, usamos como procedimento metodológico a Análise de Conteúdo, de Laurence Bardin (1977), para analisar os 50 projetos-lei, que estavam em tramitação na Câmara e no Senado Federal, até o ano de 2021, destacando nesses projetos os seguintes aspectos: temática; conceito; vocação para a prevenção ou criminalização. Como resultados principais, descobriu-se que a maior parte dos projetos-lei foram construídos a partir do ano de 2020. Também identificou-se que há um consenso com relação ao conceito de fake news, em tais projetos, que diz respeito a notícias falsas com a intenção de causar dano. A maior parte dos projetos analisados estavam ligados ao tema da Covid-19 ou ao tema das eleições, evidenciando como essas questões são sensíveis e devem ser protegidas dos prejuízos que falsas notícias podem causar.
