Centrada no Subsistema de Saúde Indígena, a atenção diferenciada sofre críticas à sua continuidade. Utilizar o instrumental bioético na defesa das especificidades da saúde indígena motivou a realização desta dissertação. Baseada em metodologia de pesquisa qualitativa, por meio de estudo de caso, utilizando-se de análise documental numa perspectiva hermenêutica, o trabalho foi precedido por revisão bibliográfica. Procurou-se descrever os acontecimentos em uma linha histórica contextualizando saúde indígena e bioética. Constatou-se que desde o “descobrimento” os povos indígenas sofreram ataques aos seus territórios e à sua saúde. Esta situação modificou-se com a República e a transformação laica do Estado. Rondon, ao implantar linhas telegráficas, buscou modificar hábitos coloniais de agressão aos índios. A criação do Serviço de Proteção aos Índios (SPI), o aparecimento dos irmãos Villas Bôas e de Noel Nutels criador das unidades sanitárias aéreas, marcam as primeiras ações em saúde indígena. A criação da Funai teve consequências importantes, embora mantendo a política de tutela, dispunha de um setor específico para a saúde, com unidades volantes atuando nas aldeias. O ponto de inflexão para as políticas indigenistas e de saúde foi a Constituição de 1988. Na área de saúde, realizaram-se a histórica 8ª Conferência Nacional de Saúde e a 1ª Conferência Nacional de Proteção à Saúde do Índio, em 1986. Nos anos 1990, com a Resolução nº 196/96 do Conselho Nacional de Saúde, a bioética passou a integrar as políticas de saúde, vinculada às pesquisas. Disseminada a partir dos princípios de autonomia, beneficência, não maleficência e justiça, a bioética, nos anos 2000, transformou-se quando submetida à crítica por outras vertentes do pensamento, voltadas aos problemas sociais. Assim, com a realização do VI Congresso Mundial de Bioética, cuja temática foi “Bioética, Poder e Injustiça”, abriu-se caminho para a politização das questões bioéticas que culminaram na Declaração Universal sobre Bioética e Direitos Humanos, da Unesco, em que a defesa da pluralidade e da diversidade cultural tem destaque. Com argumentos extraídos da Declaração e também de autores que trabalham com a perspectiva social e pluralista em bioética busca-se defender a atenção diferenciada em saúde indígena. A criação da Secretaria Especial de Saúde Indígena, no Ministério da Saúde, contrariando resolução da IV Conferência Nacional de Saúde Indígena, indicam os riscos que corre o atendimento aos povos indígenas. A manutenção do Subsistema ganhou folego com a regulamentação da Lei nº 8.080, que cita a especificidade da atenção aos indígenas. Assim, para assegurar os benefícios alcançados com o Subsistema espera-se, com esta dissertação, apresentar argumentos para a construção de espaços dialógicos e plurais onde os segmentos interessados em saúde indígena desfrutem de instâncias de debate autênticas que assegurem políticas de saúde em bases bioéticas. ______________________________________________________________________________ ABSTRACTIntroduction of indigenous population health attention policy has contributed to improve life conditions of such populations. Centered on the Indigenous Health Subsystem, the differentiated attention undergoes criticism towards its continuity. The use of bioethical instrumental in defense of indigenous health specificities has motivated the accomplishment of this work. Based on qualitative research methodology of case study by using documental analysis in a hermeneutic perspective, this dissertation was preceded by a bibliographic review. Thus, it has been sought to describe events in a historical line by contextualizing indigenous health and bioethics. It has been found that indigenous peoples have suffered attacks to their territories and to their health since the “discovery”. This situation was modified with the Republic and laic transformation of the State. Rondon, by establishing telegraph lines, changing habits of colonial aggression against the Indians. Creation of Protection Service to Indians (SPI), appearance of personalities such as the Villas Bôas brothers and Noel Nutels, creator of the Airborne Sanitary Service Units, have promoted the first systematic actions of intervention in indigenous health. The replacement of old SPI by Funai had important consequences. Funai would have a specific sector for health, with mobile health units operating in villages. The inflexion point for indigenous and health policies was the Constitution of 1988. In health, the historic 8th Health Conference and the 1st Conference of Health Protection of the Indigenous People were held in 1986. In the nineties, with Resolution no. 196, bioethics started to integrate health policies linked to researches in its principlism model. Disseminated from the principles of autonomy, beneficence, non-maleficence and justice, bioethics transformed itself throughout the 2000years when it was submitted to criticism by other areas of thoughts, with agenda addressed to social problems. Therefore, with the holding of VI Bioethics World Congress on the subject matter “Bioethics, Power and Injustice” in 2002, a way was opened to the politicization of issues which culminated in the Universal Declaration on Bioethics and Human Rights in 2005, in which defense of cultural diversity and plurality was highlighted. Based on the Declaration and also on different authors with a social and pluralist perspective of bioethics, the aim of this work is to defend the Subsystem. The creation of the Indigenous Health Special Secretariat, against resolution taken at the IV National Conference of Indigenous Health, indicates risks that differentiated assistance to the indigenous peoples runs. Hope concerning the Subsystem´s preservation appeared in a recent regulation of Law no. 8.080 that states indigenous attention specificity.
