Historical and regulatory planning law in educational path: precepts of the Constitution in 1988 to LDB nº 9394/96

Resumo: This text deals with the historical and normative trajectory of precepts / and principles of education planning in the context of post 1988 federal law On methodological basis of qualitative research with emphasis on literature (literature review) and documentary research legal basis prioritized If analyze the constitutional principles (the Constitution of 1988) and of the law of Directives and Bases of National Education No. 9394/96 on the planning of education (and school). It is worth highlighting the social relevance of participatory planning and their contributions, especially for the formulation and implementation of educational policies in the construction of the Brazilian Democratic State Law. The analysis of historical and normative trajectory of Brazilian educational planning is worth reiterating, in this textual space, the argument of the researcher José Silverio B. Horta (1982 p. 236) when he says that 'law and educational planning' figure as 'basic mechanism of state intervention'. Educational policy in the light of democracy requires the experience of participatory planning as an instrument / channel and democratization of Brazilian education.

En base metodológica de investigación cualitativa con destaque para la investigación bibliográfica (revisión de la literatura) e investigación documental de base legal se priorizó analizar los principios constitucionales (de la Constitución Federal de 1988) y preceptos de la Ley de Directrices y Bases de la Educación (LDB) Nacional nº 9394/96 cuanto a la planificación de la educación (y escolar). Cabe destacar la relevancia social de la planificación participativa y de sus contribuciones, especialmente, para la formulación y la implementación de políticas públicas educacionales en la construcción del Estado Democrático de Derecho Brasileño. Cuanto al análisis de la trayectoria histórico-normativa de la planificación educacional brasileña merece reiterar, en este espacio textual, la argumentación del investigador José Silvério B. Horta (1982, p. 236), que afirma que la ‘legislación y la planificación educacional’ figuran como ‘mecanismos básicos de intervención estatal’. La política educación a la luz de la democracia requiere la vivencia de la planificación participativa como instrumento/y canal de democratización de la educación brasileña.Este texto versa sobre a trajetória histórico-normativa dos preceitos e princípios do planejamento da educação no contexto da legislação federal pós 1988. Em base metodológica de pesquisa qualitativa com destaque para a pesquisa bibliográfica (revisão de literatura) e pesquisa documental de base legal priorizou-se analisar os princípios constitucionais (da Constituição Federal de 1988) e preceitos da Lei de Diretrizes e Bases da Educação Nacional nº 9394/96 quanto ao planejamento da educação (e escolar). Cabe destacar a relevância social do planejamento participativo e de seus contributos, especialmente, para a formulação e implementação de políticas públicas educacionais na construção do Estado Democrático de Direito Brasileiro. Quanto à análise da trajetória histórico-normativa do planejamento educacional brasileiro vale reiterar, neste espaço textual, a argumentação do pesquisador José Silvério B. Horta (1982. p. 236), quando este afirma que a ‘legislação e o planejamento educacional’ figuram como ‘mecanismo básicos de intervenção estatal’.
