Resumo: As one of the largest prison populations in the world, Brazil is facing an uncontrollable situation where government institutions fail to provide any kind of positive outcome to the problems faced on a daily basis. Inmates live in overcrowded, unhealthy, degenerate establishments. We are led to ask ourselves: What dictates govern the present prison crisis? We intend to draw a theoretical outline of the main problems of the Brazilian Penitentiary System analyzing them in perspective with the modern criminological theories, thus proposing new directions of the issue. Presos vivem em estabelecimentos superlotados, insalubres, degenerados.  De tal forma somos levados a nos perguntar: Quais os ditames regem a crise carcerária atual? Temos como intuito, traçar um esboço teórico dos principais problemas do Sistema Penitenciário brasileiro analisando-os em consonância com as teorias criminológicas modernas propondo assim novos direcionamentos de na questão.
