Resumo: O presente artigo visa compreender se o movimento feminista, ao abordar a abrangência da Lei Maria da Penha, apropria-se e legitima a função simbólica do Direito Penal. Para isso, partiu-se do marco teórico da Criminologia Crítica e do paradigma de gênero, compreendendo o Direito Penal Simbólico e suas críticas. Em um segundo momento, foi realizada uma pesquisa empírica em 32 postagens de 6 blogs feministas, através da metodologia da Análise do Discurso. Concluiu-se que o discurso do Direito Penal Simbólico, percebido com o predomínio das funções simbólicas sobre as funções reais e instrumentais do direito, está presente no discurso do movimento feminista. No entanto, no discurso das blogueiras analisadas, elas apresentam críticas ao sistema penal, em especial à questão dos preconceitos machistas e racistas dos agentes. Ainda assim, requerem a expansão do sistema, o agravamento das penas e a tipificação de novos crimes, o que leva a crer que suas críticas estão fundadas numa abordagem conjuntural da deslegitimação do sistema de controle penal. Abstract: The present aticle aims to understand if the feminist movement, when addressing the extent of the Maria da Penha Law, appropriates and legitimizes the symbolic function of criminal law? For this, we started with the theoretical mark of Critical Criminology and the gender paradigm, understanding the Symbolic Criminal Law its critics. In a second step, the empirical research was conducted in 32 posts from 6 feminist blogs, through the methodology of discourse analysis. It was concluded that the discourse of Symbolic Criminal Law, conceptualized as the predominance of symbolic functions above the real and instrumental functions of law, is present in the feminist movement discourse. However, in the speech of bloggers analyzed, they have criticized the criminal justice system, particularly the issue of sexist and racist prejudices of its agents. Still, they require system expansion, aggravation of penalties and the typification of new crimes, which suggests that their criticisms are based on a conjunctural approach of the delegitimization of penal control system.
