BEYOND THE CONSTITUENT POWER: : THE DEMOCRATIC SYSTEM AS THE FOUNDATION OF AN IMMUTABLE CORE OF FUNDAMENTAL RIGHTS

Resumo: This paper intends to question the dichotomy between the constituent power and the reform power as the foundation of the eternity clauses of the constitutional system. For this, the works of Emmanuel Joseph Sieyès and Carl Schmitt were revisited, along with the analysis of contemporary pieces, especially the works of Monika Polzin, Ulrich Press, Norberto Bobbio and Luigi Ferrajoli. The aim is to demonstrate that a supposed hierarchy of the constituent power, as "representative of the nation," is not sufficient to substantiate the immutability of constitutional norms. The conclusion of this article is that this reasoning is inadequate, but that does not imply that there is not an immutable core, as this paper concludes that there is an unalterable core of fundamental rights, whose foundation derives from the democratic system itself. Democracy.O trabalho pretende questionar a dicotomia entre poder constituinte e de reforma como fundamento das cláusulas pétreas do ordenamento constitucional. Para isso, foram revisitadas as obras de Emmanuel Joseph Sieyès e Carl Schmitt, juntamente com a análise de obras contemporâneas, das quais se destacam os trabalhos de Monika Polzin, Ulrich Preuss, Norberto Bobbio e Luigi Ferrajoli. O objetivo consiste em demonstrar que uma suposta hierarquia do poder constituinte, como “representante da nação”, não é suficiente para fundamentar a imutabilidade de normas constitucionais.
