Resumo: This article analyzes the illegitimacy of symbolic criminalization in Brazilian’s law of environmental crimes, adopting Jürgen Habermas’s jusphilosophical theory as a framework, with the aim of debating the protection of legal interests in a scenario of criminal law’s expansionism. Therefore, a qualitative approach was used, based on the hypothetical deductive method and through exploratory research. In the end, it is concluded that the understanding of the legal interests from the habermasian theory can be a basis for the reflection on the tense relationship between criminal law’s expansionism and it’s classic principles, which limit the punitive power. Para tanto, utilizou-se de uma abordagem qualitativa, a partir do método hipotético dedutivo e por meio de uma pesquisa exploratória.
