Indigenous peoples: between the language of law and the right to language

Resumo: Our paper takes as objective to discuss the ways in which native languages have been silenced, and, consequently, many rights denied to indigenous peoples, when official identification criteria link the subject to the mastery of a native language. Many are the factors that contribute to the silencing: the classification by specialists of the original languages; the in vitro analysis of these languages, when their materiality as orality languages is erased or misunderstood and transformed into "metallic languages". Finally, we seek to understand the functioning of the language of law and the denial of the right to language. From Discourse Analysis, we adopt as main assumptions the notion of forms of silence (ORLANDI, 1992), the notion of the language of Mars (GADET and PÊCHEUX, 2002) and the constitution of the subject-form and the concept of ethno-discursive identity (SOUZA, 2020).
