Resumo: Psychopathy comes from a personality disorder and features as main characteristics a degenerate change of character and emotionless. This work was developed about the analysis of a psychopath towards the legal interpretation approach of psychiatry and psychology. It will be demonstrated in a accurate way the major historic marks, personal identity nuances, main characteristics, relevant classifications of psychopathy disorder, and the reason of their violent and repulsive behavior towards the society. The constructional process of this work was accomplished from bibliographic productions analysis, descriptive and quantitative research, manifesting compliance of the individual’s capacity according to the immutability, immutability and criminal semi-importability, as well as, demonstrate punitive treatment measures adopted by the Brazilian judiciary, pointing out guidelines developed by indoctrinators and professional specialists in psychiatric sciences, in addition to their allusive positions. All of the content discussed is based on the premise that individuals with psychopathologies that commit crimes and are not treated according to their conditions by the current psychjuridical regime, with emphasis on the importance of greater interpretation by the legislator in ratifying the current laws of the Criminal Legislation. With the main purpose of showing the effectiveness or ineffectiveness of the Brazilian punitive system, in order to finally express the pertinent ideals about the best way of acting in these cases

O trabalho desenvolve-se acerca da análise do agente portador deste trastorno de personaliade, ante o enfoque da interpretação jurídica sob o alicerce da psiquiatria e psicologia. Será demonstrado de forma concisa os precípuos marcos históricos, as nuances de identidade pessoal, os elementos característicos, as classificações pertinentes ao transtorno de psicopatia, e os motivadores de seus comportamentos violentos e repulsivos ante a sociedade. O processo estrutural desta pesquisa foi realizado a partir de analises de produções bibliográficas, pesquisas descritivas e qualitativa, manifestando a observância da capacitação do indivudo quanto a imputabilidade, inimputabilidade e semi-imputabilidade penal, bem como, demonstrar-se-á as medidas de tratamentos punitivos adotadas pelo poder judiciário brasileiro, com apontamento de diretrizes desenvolvidas por doutrinadores e profissionais especialistas nas ciências psiquiátricas além de seus alusivos posicionamentos. Todo conteúdo discorrido, parte da premissa de que os indivíduos portadores de psicopatologias cometem crimes e não são tratados na medida das suas condições pelo atual regime psicojurídico, com ênfase na importância de maior interpretação do legislador na ratificação das leis vigentes da Legislação Penal.
