Resumo: Current paper analyzes the system of precedents in Brazil and examines the legal structure that links decisions to judged cases and to trends undersigned by the courts. A short historical context is forwarded on the formation of common law and the civil law system, the latter within the Brazilian legal structure. Doctrinal agreements on the system, especially with regard to the existence of a system of precedents in Brazil are compared. Many types of approaches are criticized. Bibliographic, legislative and jurisprudential research is employed.

Bibliographic, legislative and jurisprudential research is employed.En el presente artículo se analiza el sistema de precedentes en Brasil examinando la estructura legal que trata de la vinculación de las decisiones a juzgados, las súmulas, las orientaciones firmadas por las Cortes Judiciales. Aborda un breve contexto histórico de la formación del sistema common law y civil law, siendo este último dentro de la estructura legal brasileña. Hecha esta estructuración, compara entendimientos doctrinarios acerca de esta sistemática, principalmente en lo que atañe a la idea de existencia de un sistema de precedentes en Brasil. Por fin, critica algunos de estos abordajes. Utiliza como metodología la investigación bibliográfica, legislativa y jurisprudencial.O presente artigo analisa o sistema de precedentes no Brasil examinando a estrutura legal que trata da vinculação das decisões a julgados, as súmulas, as orientações firmadas pelas Cortes Judiciais. Aborda um breve contexto histórico da formação do sistema common law e civil law, sendo este último dentro da estrutura legal brasileira. Feita esta estruturação, compara entendimentos doutrinários acerca desta sistemática, principalmente no que tange a ideia de existência de um sistema de precedentes no Brasil. Por fim, critica algumas destas abordagens.
