Right and axiology: the human being value as a fundament for personality rights

Resumo: Social values in a society form axioms, which become norms that establish the social conduct and, at the same time, protect life, the human being and their values. The Law follows the social development and has protected the internal values of human beings, subjectively constituting the human being as the center of the Law. As a result, the person acquires the protection of the State and, as being the center of the Law, the superiority of the human being value is established in relation to other values. Axiology and Law are necessary studies to understand the human being value, and personality rights are anchored in this value. Human dignity, as an individual right, is structured on the moral and interior value of the human being, which needs to receive from the State the basic conditions for a life in plenitude, having the necessary conditions to develop as a person, besides guaranteeing that their values will be respected. Personality rights, have its foundations, its basis, on the values of the human being, conquered by constitutional principles, guaranteed by the Federal Constitution of 1988.

El derecho acompaña el desarrollo social y tiene tutelado los valores interiores del ser humano, constituyendo, en la subjetividad, la persona humana como centro de Derecho. Con eso, la persona adquiere la protección del Estado y, como centro del derecho, es establecida la superioridad del valor de la persona humana en relación a otros valores. La axiología y el derecho son estudios necesarios para com-prenderse el valor de la persona humana, y los derechos de personalidad están basados en ese valor de persona. La dignidad humana, como derecho personalísimo, se estructura en el valor moral e interior del ser humano, que necesita recibir del estado condiciones básicas para una vida en plenitud, habiendo condiciones de desarrollarse como persona, además de garantizar que sus valores sean respetados. Los derechos de personalidad tienen en el valor de la persona humana su cimiento, su base, conquistados por medio de los principios constitucionales, tutelados por la Constitución Federal de 1988.Os valores sociais de uma sociedade formam os axiomas, os quais, se transformam em normas que estabelecem a conduta social e, ao mesmo tempo, tutelam a vida, a pessoa humana e os seus valores. O direito acompanha o desenvolvimento social e tem tutelado os valores interiores do ser humano, constituindo, na subjetividade, a pessoa humana como centro do direito. Com isso, a pessoa adquire a proteção do Estado e, como centro do Direito, é estabelecida a superioridade do valor da pessoa humana em relação a outros valores. A axiologia e o Direito são estudos necessários para compreender o valor da pessoa humana, e os direitos da personalidade estão ancorados nesse valor da pessoa. A dignidade humana, como direito personalíssimo, estrutura-se no valor moral e interior do ser humano, que precisa receber do Estado condições básicas para uma vida em plenitude, tendo condições de se desenvolver como pessoa, além de garantir que seus valores sejam respeitados.
