Preventive Function of Behavior Adjustment Term in the Reparatory Tutelage of Environmental Disasters

Resumo: Behavior Adjustment Term (BAT) has been employed in Brazilian law as a reparation tool for environmental damage. Although it is a fast mechanism for the attribution of environmental civil accountability, it is highly relevant to analyze whether BAT complies with the prevention of new environmental disasters. A research based on the Environmental Disaster Law investigates the preventive function of BAT in environmental disasters using as parameter the terms employed in the cases of dam rupture in Minas Gerais in 2015 and 2019. The preventive function and environmental reparation are underscored through environmental civil accountability. The role of BAT is analyzed with regard to the reparation of environmental damage and the (in)sufficient preventive feature of the tool to avoid the occurrence of other disasters.

Aunque sea un mecanismo célere a la atribución responsabilidad civil ambiental, relevante se hace analizar sí la utilización del TAC cumple la función de prevención a nuevos desastres ambientales. A partir de una investigación pautada en el Derecho de los Desastres Ambientales, en el artículo se tiene por objetivo analizar la función preventiva del TAC en desastres ambientales, teniéndose como parámetro los términos utilizados en los casos de rompimiento de represas en Minas Gerais en los años de 2015 y 2019. Para tanto, se destaca la función preventiva que la reparación ambiental presenta, por intermedio de la responsabilidad civil ambiental. A partir de esa comprensión, se analiza el papel desempeñado por el Término de Ajuste de Conducta en la reparación de daños ambientales y el (in)suficiente carácter preventivo del instrumento para evitar la ocurrencia de nuevos desastres.O Termo de Ajustamento de Conduta (TAC) tem sido amplamente utilizado no direito brasileiro como instrumento de reparação dos danos ambientais. Embora seja um mecanismo célere para a atribuição reponsabilidade civil ambiental, relevante se faz analisar se a utilização do TAC cumpre a função de prevenção a novos desastres ambientais. A partir de uma pesquisa pautada no Direito dos Desastres Ambientais, o artigo tem por objetivo analisar a função preventiva do TAC em desastres ambientais, tendo-se como parâmetro os termos utilizados nos casos de rompimento de barragens em Minas Gerais nos anos de 2015 e 2019. Para tanto, destaca-se a função preventiva que a reparação ambiental apresenta, por meio da responsabilidade civil ambiental.
