Caring Ethics: Literature as a form of Sensitivity in Human Rights

Resumo: The ability to see things through the eyes of others and asking about the other´s sufferings and pain seem to be very distant from the technical and formal domains of law. Law lack this type of sensitiveness. However, the sensitive understanding of reality is kept in literary works. It also seems to be kept in studies on human rights which still persist in the compassionate meanings of justice. Current analysis explores intersections between literature, sensitiveness and human rights in ethics based on caring. Caring in human rights occurs in the between the lines of the literature. This has a deep significance, revolutionary and emotive, since it is empathic, poetic, feminine to produce caring in human rights. Current study employs the deduction and hypothesis approach and techniques in bibliographical and documental research.

El alcance de la otra persona, la capacidad de ver el mundo por intermedio de sus ojos y preguntar por sus dolores y necesidades parece cada vez más lejos de los técnicos, puros y formales dominios de la ciencia del derecho. Les faltan esas sensibilidades en derecho. Sin embargo, si anestesiada en derecho, la comprensión sensible del mundo y de los seres permanece guardada en las obras literarias. Y parece también permanecer guardada en los estudios de derechos humanos, que aún persisten en un derecho un poco más consciente de sus sentidos compasivos de justicia. Con ese propósito, en el presente estudio se busca explorar las intersecciones entre literatura, sensibilidades y derechos humanos, en una dinámica éticamente fundada por el cuidar. Cuidados en derechos humanos transbordan en las sensibles entrelineas de la literatura. En esa medida que es profundamente significante, y se puede decir revolucionaria, pues emotiva, empática, poética, de trazos femeninos y esenciales a sensibilizar y cuidar en derechos humanos. En el estudio se utiliza el método de abordaje deductivo-hipotético y de las técnicas de investigación bibliográfica y documental. O alcance da outra pessoa, a capacidade de ver o mundo através de seus olhos e perguntar por suas dores e necessidades parece cada vez mais distante dos técnicos, puros e formais domínios da ciência do direito. Faltam essas sensibilidades em direito. No entanto, se anestesiada em direito, a compreensão sensível do mundo e dos seres permanece guardada nas obras literárias. E parece também permanecer guardada nos estudos de direitos humanos, que ainda persistem num direito um pouco mais consciente de seus sentidos compassivos de justiça. Com esse propósito, o presente estudo busca explorar as intersecções entre literatura, sensibilidades e direitos humanos, numa dinâmica eticamente fundada pelo cuidar. Cuidados em direitos humanos transbordam nas sensíveis entrelinhas da literatura. Nessa medida que é profundamente significante, e pode-se dizer revolucionária, pois emotiva, empática, poética, de traços femininos e essenciais a sensibilizar e cuidar em direitos humanos. O estudo utiliza do método de abordagem dedutivo-hipotético e das técnicas de pesquisa bibliográfica e documental.
