Resumo: The implications of the Brazilian juridical order within the future code of Civil Law are analyzed. This is especially true when mediation is introduced at the start of the demand through the actions of lawyers and parties to rationalize conflicts by different mechanisms of solutions. It is important to highlight suits involving the family which are of special attention in the new code, especially with regard to arraignment without the need to present the copy of notice. The above is a polemic and debatable issue, coupled to the use of mediation within the family in the search for a more effective action by the parties for the rational solution of demands.

The above is a polemic and debatable issue, coupled to the use of mediation within the family in the search for a more effective action by the parties for the rational solution of demands.El presente abordaje realiza la lectura de las implicaciones que el ordenamiento jurídico va a sufrir a partir del Nuevo Código de Proceso Civil, especialmente al introducir, de forma clara y expresa, la audiencia de mediación, en el inicio de las demandas, por medio de una pro-actividad de los abogados y partes, buscando racionalizar los conflictos, a partir de mecanismos distintos de solución de conflictos. Agregado a eso, se revela fundamental tratar de las acciones relacionadas al derecho de familia, que recibirán especial atención en el nuevo diploma, especialmente en relación a la cita sin la necesidad de copia auténtica de intimación, cuestión polémica y objeto de debates, sumada a la utilización de la mediación en el ámbito familiar, en la búsqueda por una acción más efectiva de las partes, en pro de una resolución racional de las demandas.A presente abordagem busca realizar uma leitura das implicações que o ordenamento jurídico brasileiro sofrerá com a entrada em vigor de um Novo Código de Processo Civil, especialmente ao introduzir, de maneira clara e expressa, a audiência de mediação, logo no início das demandas, por meio de uma pró-atividade dos advogados e partes, buscando racionalizar os conflitos, a partir de mecanismos diferenciados de solução de conflitos.
