Innovatory Aspects of the New Law on Adoption from the Perspectives of Family Planning, Responsible Fatherhood and Personal Rights

Resumo: The right to family planning and responsible parenthood were disciplined by the national legal system, taking into account the principle of human dignity and the preservation of personal rights of the child. The new adoption law at the same time enabling the completion of the project promotes the effectiveness of the parental rights of the personality of the child unable to remain in their natural family. The innovations that have improved the procedures set forth in the Statute for Children and Adolescents and the family life of children in both the biological family as the replacement, subdivided in minors rights, duties and standards of the adopting procedural nature in relation to intercountry adoption . The law was silent on the possibility of adoption by homosexual couples. The principle of human dignity, enshrined as a guide to the legal drafting and interpretation of the rules, took even more emphasized by the new decree regarding the person in training to achieve the principles of full protection and the child's best interest and adolescents.

La nueva ley de adopción, mientras que permite la realización del proyecto parental, promueve la efectividad de los derechos de la personalidad del niño imposibilitado de permanecer en su familia natural. Las innovaciones de aquella en relación a la sistemática prevista en el Estatuto del Niño y del Adolescente en relación a la convivencia familiar, deberes de los que adoptan y reglas de orden procedimental en lo que se refiere a la adopción internacional. La ley fue omisa en relación a la adopción por parejas homo afectivas. El principio de la dignidad humana, consagrado como guía del orden jurídico para la elaboración e interpretación de las normas, dio todavía más relevancia por el nuevo diploma, en que se refiere a la persona en formación, para la consolidación de los principios de la protección integral y del mejor interés del infante y del adolescente.O direito ao planejamento familiar e o exercicio da paternidade responsável foram disciplinados pelo ordenamento jurídico pátrio levando-se em consideração o princípio da dignidade da pessoa humana e a preservação dos direitos da personalidade do menor. A nova lei de adoção, ao mesmo tempo em que permite a realização do projeto parental, promove a efetivação dos direitos da personalidade do menor impossibilitado de permanecer em sua família natural. As inovações daquela aperfeiçoaram a sistemática prevista no Estatuto da Criança e do Adolescente quanto à convivência familiar de menores, tanto na família biológica quanto na substituta, sendo subdivididas em direitos dos menores, deveres dos adotantes e normas de cunho procedimental no que tange à adoção internacional. A lei foi omissa quanto à possibilidade de adoção por casais homoafetivos.
