Resumo: After the making of the new foreign exchange market law, law no. 14.286/2021, some provisions directly impacted the complementation of certain criminal types. Among them, the crimes foreseen for in articles 16 and 22 of Law 7,492/86, stand out. Thus, studying the new law and its criminal impacts is of fundamental importance. In addition, it is necessary to analyze questions of intertemporal law, since the new law will only come into force on December 30, 2022 and contains provisions that bring beneficial criminal effects to the defendants. Therefore, in view of the future and necessary retroactivity of the most beneficial criminal law, it should be applied immediately, to also encompass the conducts practiced before it.

Entre ellos, se destacan los delitos previstos en los artículos 16 y 22, ambos de la Ley 7.492/86. Por lo tanto, el estudio de la nueva ley y sus repercusiones penales es de fundamental importancia. Además, se enfatiza la necesidad de analizar las cuestiones de derecho intertemporal, ya que la nueva ley solo entrará en vigencia a partir del 30/12/2022 y contiene disposiciones que traen efectos penales beneficiosos para los acusados. Por ello, ante la futura y necesaria retroactividad de la ley penal más beneficiosa, debe aplicarse inmediatamente, para abarcar también las conductas practicadas ante ella.A partir da edição da nova lei do mercado de câmbio, lei nº 14.286/2021, algumas disposições impactaram diretamente na complementação de certos tipos penais. Deles, destacam-se os crimes previstos nos artigos 16 e 22, ambos da lei 7.492/86. Dessa forma, estudar a nova lei e seus impactos criminais é de fundamental importância. Além disso, ressalta-se a necessidade de analisar questões de direito intertemporal, vez que a nova lei só entrará em vigor a partir do dia 30/12/2022 e contém disposições que trazem efeitos penais benéficos aos réus. Portanto, em face da futura e necessária retroatividade da lei penal mais benéfica, deve ser aplicada imediatamente, para também abarcar as condutas praticadas anteriormente a ela.
