Parents´ Authority and Limits of Person´s Rights Within the Technological Context

Resumo: Current paper discusses the limits of parents´ authority on the rights of the person in the family, based on the present constitutional and democratic scenario, with the inclusion of difficulties within the digital conditions of the Internet. Research discusses parents´ authority on the rights of young people within the background of the digital age and distancing of the parents within the context of children´s almost total immersion in the Internet. A bibliographic investigation, through the deductive method, was employed to perceive the limits and possibilities of the theme. Current paper approaches parents´ authority and current family model and its relationship with family authority, the rights of the person and the limits and possibilities of parents´ authority within the current model of a democratic and constitutional family. Results show that, although rights may be removed, since they are not absolute, the best path for conviviality within such dichotomy is dialogue and education.

La investigación tiene como problema a ser pensado los límites de la actuación de la autoridad parental sobre los derechos de la personalidad de los más jóvenes, tiene como telón de fondo la actual era digital y algún alejamiento de los padres frente a casi total inmersión de los hijos en la Internet. Para tanto, se utilizó de la investigación bibliográfica, con el método deductivo con intención de observar los límites y posibilidades de la temática. Por lo tanto, el estudio tiene primeramente un abordaje actual del modelo de autoridad parental y del actual modelo de familia y su relación con el poder familiar, los derechos de la personalidad y por fin los límites y posibilidades de la autoridad parental en el modelo actual de familia democrática y constitucional. Se concluye que, aunque los derechos en cuestión puedan ser alejados, por no ser absolutos, el mejor camino a la convivencia de la dicotomía de principios sea el diálogo y la educación.Discute-se sobre os limites da atuação do poder parental sobre os direitos da personalidade na família, tendo como eixo temático o atual panorama constitucional e democrático, adotando para tanto alguns percalços sentidos na era digital da internet. A pesquisa tem como problema a ser pensado os limites da atuação da autoridade parental sobre os direitos da personalidade dos mais jovens, tendo como pano de fundo, a atual era digital e algum distanciamento dos pais frente a quase total imersão dos filhos na internet. Para tanto, utilizou-se da pesquisa bibliográfica, com o método dedutivo com intenção de observar os limites e possibilidades da temática. Portanto, o trabalho tem primeiramente uma abordagem atual do modelo de autoridade parental e do atual modelo de família e sua relação com o poder familiar, os direitos da personalidade e por fim os limites e possibilidades da autoridade parental no modelo atual de família democrática e constitucional. Conclui-se que, embora os direitos em questão possam ser afastados, por não serem absolutos, o melhor caminho para a convivência da dicotomia de princípios seja o diálogo e a educação.
