Responsibility of Famous Actors in Elderly-People-Addressed Advertisements on Payday Loans

Resumo: | Advertisements on payday loans addressed to retired elderly people, often with the participation of famous people in the social media, have been lately on the increase. Frequently the elderly audience is deceived by such advertisements, especially when the person showing the product is vested with faith and confidence by the public. This fact is specifically exacerbating when the audience consists of the elderly who, owing to their special status in society, have been treated differentially through the Elderly People Statute (Law 10.742/03). The practice of payday loans, advertisements and the responsibility of famous people in the media should be examined from the point of view of the Brazilian Consumer Code (Law 8.078/90) and the Elderly People Statute so that abuses against people in that age group could be avoided. |

Lo que pasa es que el destinatario es engañado por la publicidad principalmente cuando ésta deposita cierta confiabilidad en la persona que presenta el producto. Tal situación sufre un agravio cuando el público son los ancianos, personas que, por su condición especial en la sociedad recibieron tratamiento distinto por medio del Estatuto del Anciano (Ley 10.742/03). Desde esa perspectiva, se vuelve importante analizar el instituto del crédito consignado, publicidad y responsabilidad de la celebridad que participó de la campaña publicitaria desde la perspectiva de la óptica del Código del Consumidor (Ley 8.078/90) y del Estatuto del anciano para que se eviten abusos en contra personas de esa edad.É visível o aumento de publicidade voltada para os idosos acerca do crédito consignado, muitas vezes com a participação de pessoas famosas na mídia. Ocorre que muitas vezes o público-alvo é ludibriado pela publicidade principalmente quando esta deposita certa confiança na pessoa que lhe mostra o produto e isso é agravado quando o público são os idosos, pessoas que, por sua especial condição na sociedade receberam tratamento distinto através do Estatuto do Idoso (Lei 10.742/03).
