Effects of the Constitution on Individual Rights: The Constitutionalization Process

Resumo: The historical process involving constitutional norms, particularly the fundamental rights of the human being, and their relationship with the laws on individual rights is discussed. The essay deals with the phenomenon of decoding civil law where it concedes space for the Constitution to take over the centrality of the legal system and distribute its effects to all branches of law. Current discussion exposes the constitutionalization of civil law as a consequence of the place given by constitutional norms. The 1988 Brazilian Constitution represents the duty of society so that the transformation of social reality is materialized and the protection of human dignity is guaranteed.

Trata del fenómeno de la descodificación del derecho civil donde este posibilita que la Constitución asuma la centralidad del ordenamiento jurídico e irradie efectos bajo todas las ramas del derecho. Expone todavía la constitucionalización del derecho civil como consecuencia de ese puesto asumido por las normas constitucionales. Concluye que la Constitución Federal de 1988 representa un deber de toda la sociedad para que se realice la transformación de la realidad social y garantice la protección de la dignidad de la persona humana.O presente artigo analisa o processo histórico percorrido pelas normas constitucionais, em especial os direitos fundamentais, e sua relação com as normas de direito privado. Trata do fenômeno da descodificação do direito civil onde este dá espaço para que a Constituição assuma a centralidade do ordenamento jurídico e irradie efeitos sob todos os ramos do direito. Expõe ainda a constitucionalização do direito civil como decorrência desse posto assumido pelas normas constitucionais.
